The paper reports that Nelson got into an altercation with James Paolino, 74, and Philip Falcone, 73, in Queens, New York on August 30. According to the NYPD, Nelson began punching the men after one of them told him, “You had a rough night.”

“He started kicking me and punching me in the head,” Paolino tells the Daily News. “He knocked me down. I’m on the floor, bleeding. He broke my glasses and I knew the next kicks were coming for my head. I’m helpless.”

Nelson’s civil lawyer disputes the allegations, saying, “I’ve seen the video, and what they’re saying is not correct.”

“I can tell you that there was no bloody altercation,” the lawyer says. “That’s completely false.”

According to the Daily News, Nelson was arraigned in Queens Criminal Court Wednesday night, and was released on his own recognizance. He’s due back in court October 11.

Nelson sang in Anthrax from 2007 to 2009. He didn’t appear on any albums, but he has songwriting credits on 2011’s Worship Music.
